CBD Small Businesses
Many individuals have begun selling CBD products on a small scale, even from their homes or through social media; however, it is important to be aware of regulations you MUST follow when selling any type of cannabis or hemp derived product.
In some states, you must register a CBD business and submit complex paperwork providing origin, testing, certification, and product labeling information, and failing to do so can result in hefty fines or even the loss of your business.
Selling CBD Oil
CBD oil has become a popular health and beauty product. Though people often use it to relieve pain, anxiety, and more, there are disputes over claims that have been made about the success of CBD oil, and sellers should avoid making promises about their products. It’s always best to develop a strong marketing message that also considers the legality of claims.
What Is CBD?
Cannabidiol, also called “CBD,” is a chemical found in marijuana and has two classifications. Full spectrum CBD contains only trace amounts of the psychoactive ingredient tetrahydrocannabinol (THC) while Broad spectrum CBD contains no THC at all . CBD can be sold in oil, tincture, extract, vaporized liquid, or capsule form. CBD oils are often used to make products that promote health and beauty, such as oils, creams and pain relief salves and ointments.
Is CBD Legal?
CBD is federally legal in all states, but in most states it must be derived from hemp and must contain less than 0.3% THC. CBD derived from cannabis is considered a Schedule I drug and is illegal under federal marijuana laws.
What Is Delta 8 and Delta 9?
Both Delta 8 and Delta 9 are both naturally occurring in cannabis plants; however, Delta 8 products are synthesized, extracted and purified from CBD or from Delta 9 THC. Delta 9 products also occur naturally in cannabis plants and can be synthesized or extracted from CBD, but it can also be consumed in natural form (flower) which can produce a euphoric high or intoxicating effect.
Can I Get Arrested for CBD?
CBD that is derived from hemp is not illegal to possess in any U.S. state, though there have been instances where CBD has been mistaken for marijuana or cannabis products that are illegal. In those situations, it is important to comply with the police and remain calm if facing arrest but contact a CBD attorney or marijuana criminal defense lawyer for help immediately. CBD products are legal in Arkansas provided they contain .3% THC or less and are derived from hemp. On April 11, 2023, Arkansas Governor, Sarah Sanders signed SB358, making Delta 8 illegal to purchase in Arkansas. Delta 9 remains legal for registered medical marijuana card holders.
